I find it hard to believe that Grail Games, Matagot and Kolossal have all intentionally violated their licensing agreements.

The more news I see about this, the more I want to see the actual contract language.

I wonder whether this is something about separating sales/editions to different regions; there have been hints along those lines. Certainly I had no difficulty finding on Amazon UK the Oink Games Modern Art that “is for sale within Germany and Austria only”.

Im guessing the publisher cant sell them directly to other regions(?) But if Amazon bought some and have them for sale in their EU shop, then that’s fine?

I did saw BGG Store selling the Spanish version of Hollywood Golden Age. Im curious on how BGG got their copies (which are in Spanish) in the first place.

It can be more complicated than that: Levi Strauss v. Tesco (2002) found that Tesco could not buy jeans wholesale in Eastern Europe and sell them at a profit in the UK, in spite of theoretical free trade across Europe. If the publisher sells them wholesale to Amazon knowing that they will be sold in an unauthorised region, that would probably be considered a violation of the publisher’s contact with RK. But of course this would depend on the exact wording of the contracts, which we won’t know.

(Personally I think region segmentation is daft, and generally used as a way for producers to maximise their profits by allowing them to set different prices in different places even when shipping between them is cheap. But it’s what we have.)
