I don’t think so… 9.3 says ‘after taking casualties’… I think it’s different to invasions, where you can surrender before the attack (10.3 is quite explicit that you can surrender in invasions before taking casualties).
I had certainly assumed that “place” and “build” were separate things, but the counterarguments are convincing.
No - you can surrender a planet in the face of an invasion, but you have to fight at least one round of the space battle.
